It definitely sucks to have your name dragged through the mud just to be judged not guilty, but I think this is a bit overstated. As it so happens, I believe the end of the case coincided with the end of his contract so it's not like he missed out on any money. I also would be surprised if he doesn't sign with a Ligue 1 or better club for this season.

In England and Wales, more than 99% of rapes reported to police do not end in a conviction. This is the result of a criminal justice system that makes prosecuting rape extremely rare, lengthy and difficult.

At present, charge rates for rape vary wildly between regions, from 1.3% in Surrey to 8.2% in Durham. Cases take, on average, 817 days to reach court, and 63% of cases are closed because the victim has given up on the process and withdrawn from it.

Burnwinter I mentioned these stats to someone and he informed me the conviction rate once the case reaches court is actually quite high. I have done some googling and it looks like he wasn't chatting bollocks:

The research, published in the Criminal Law Review, examined all charges, pleas and jury verdicts for all defendants in the Crown Court in England and Wales over a 15-year period from 2007-2021. The study analysed almost six million charges against defendants and includes every single verdict reached by a jury on rape charges in this period (68,863 jury verdicts by deliberation).

In 2021, the most recent year with full data, the jury conviction rate for all rape charges was 75%, up from 55% in 2007. The finding that juries convict more often than they acquit defendants in rape cases was also true regardless of the age or sex of the rape complainant.

Tactics Yep, because in such cases they more or less don't go to trial unless a guilty verdict is realistic. Note the average of 817 days to even get to court, relating back to my earlier post with more anecdotal accounts of how long those preliminaries can be, including before charges are laid (or not).

You'd have to screw your eyes up at the system to imagine it's somehow favouring victims of rape, or that it's easy to exploit in the small proportion of cases that involve false accusations.

Trials aren't fun for plaintiff or defendant, but in the mean the legal system doesn't create the intended consequences for perps.

Jurisprudential reforms such as the principle of "affirmative consent" are worth a look.

Burnwinter pretty much this. Think of it as a funnel with incredibly high drop-offs: assaults —> reports — > investigations —> sufficient evidence to go to court —> trial —>. Conviction. Even if you have a 60% conviction rate, the drop off by the time you get there is extremely high. These are the hardest crimes to prove. I have a lot of sympathy for wrongly accused men, but these cases are a fraction of the real cases that don’t make it out of step 1 or 2.

Claudius the stat above also ignores the reality that most convictions aren't won at trial. They're agreed without ever going to trial. Prosecutors wont go to trial at all unless they are extremely confident of getting a win.

it's better for a guilty man to go free than an innocent one to go to prison. that's more corrosive to the system than any talk about how hard it is to convict. it should be hard. but once you have to face a jury of your so called peers, god help you ... better have some money for a good lawyer or else you'll be some sad story that people like you say "awwwh that was so unfortunate, but so many rapists get off though so ..."

This is not true. The problem is exactly the opposite - that there is a systematic tendency to disbelieve women. Metoo has not fixed that.

Meatwad the best thing we can do is improve the first two steps of the funnel. Make it easier to report and improve investigations so that it is easier to prove / disprove. The second step should help the falsely accused men. But both steps would go a long way to making it easier for victims to get justice, and potentially also reduce incidents (assuming justice is a deterrent to criminals). But we cannot design justice based on the exceptions.

As far as football's concerned, main point is the legal process is a red herring because it doesn't work. Better to look at how clubs sanction players and cultural change.

There have been a few rumours on Twitter that the club isn't too happy with his attitude as well. Remember reading around the time he was dropped he'd been out clubbing before big matches.

Selling him was never going to be about improving on him and instead just making the economical decision in the event of a big offer from Saudi.

This is massive if we keep him. He's elite in his position and can give us time to let our new midfield bed in properly. Doesn't make much sense to sell both him and Xhaka in the same window regardless of who we are bringing in.

Being able to rest him would be massive too. Ode, Rice and Partey for the tougher games, swap one for Havertz any time we need to rest someone or if we want to go more attacking.
