I appreciate his saying it but, well, obvious things are obvious.
It is also clearly interpreted in a way that is totally inconsistent not only with how it is written, but its context within the Constitution, as well as the context of the various debates and statements that founding fathers put forward at the time. Any real constitutional originalist (i.e. not a bigoted racist scumbag) would immediately deem the current interpretation skewed at best.
Legal documents come down to definitions of terms, and they are not adequately defined, so we only have the the context to go by. That being said, it shouldn't be up for such interpretation, and just proves that the FFs were fucking hacks who put together a fairly clumsy document in the end.
