May be they know they're doing it just to delay the whole thing till someone else bids for him and then sell him for the same 40 million. But, most-probably, Suarez's agent has done a shit job and has made his client sign a contract that is not water-tight.
Actually we can easily imagine Liverpool telling Suarez when he was signing the contract "Ok, as per your wishes we have added in this clause that if a champions league club (provided we didn't qualify), bid above 40m for you, we will start negotiations with them."
Suarez will easily think its a release clause.

I mean, most of us could see this coming, why didn't he act faster? It was obvious our options were diminishing so quickly from early on. He nailed the exact difficulty of this transfer window, and we are unlucky that we only have money at this window and not last few windows.
