Yeah, the active/inactive offside is such a bullshit rule. If you're on the field you affect the game, period. It's the linesman's job to rule people offside, not the defender's. Look at the goal Everton scored against us last season, for instance. Saha was a country mile offside when the pass over the top came, but Koscielny didn't know whether the linesman would blow or not and tried to get to the ball. In the end he got a foot on it but couldn't get it out of the way, Saha got hold of it and scored a perfectly legitimate goal.
